Access to Data from Connected Products and Related Services

Many STIEBEL ELTRON products can be digitally connected. Their use may generate data, for example about the operation, condition, settings, energy consumption or possible faults of the device. The EU Data Act gives users of connected products and related services certain rights regarding this data.

The EU Data Act has applied since 12 September 2025. Its purpose is to ensure fair access to and use of data from connected products. The following information explains how you can exercise your rights in relation to STIEBEL ELTRON. 

Who has these rights?

You may have rights under the EU Data Act if you use a connected STIEBEL ELTRON product or related service. This may be the case, for example, if you own, rent or lease the device or use a related digital service.

These rights are available to both individuals and businesses. The relevant question is whether you are entitled to use the product or service within the meaning of the EU Data Act.

What data is covered?

The EU Data Act covers data generated through the use of a connected product or related service. Depending on the device and its technical features, this may include operational, status, measurement, consumption, settings, fault, diagnostic or maintenance data. It may also include metadata needed to understand and use that data.

Not every product generates or stores such data. The data actually available depends on the relevant product, related service and technical design. As a rule, the right does not cover content created through further analysis or complex calculations going beyond the processing of data generated directly by the product or service.

How can you obtain your data?

If you cannot already access the data directly through the product or related service, you may request it from STIEBEL ELTRON. The data available to you will be provided without undue delay, easily and securely, and generally free of charge.

The data will be provided to the same extent and with the same quality as it is available to STIEBEL ELTRON. You will receive it in a comprehensive, structured, commonly used and machine-readable format. Where technically possible and appropriate, access may be continuous and in real time.

Can you share the data with a third party?

You may request that the covered data be transmitted to a third party of your choice. This could be, for example, a specialist contractor engaged by you, an energy service provider or a provider of an additional digital service. Please tell us which data should be transmitted and identify the intended recipient. The recipient may generally use the data only for the purposes agreed with you and must comply with the EU Data Act. Data cannot be provided under this right to companies designated as gatekeepers under the Digital Markets Act.

Please describe as precisely as possible the product or related service concerned and the data you wish to receive or have transmitted to a third party. Where available, please provide the product name, serial number or device ID and the relevant period. To protect your data, STIEBEL ELTRON may verify that you are entitled to use the product or service and to receive the data. We may therefore ask for additional information or suitable evidence. Please initially provide only the information required to identify and process your request.

How may you use the data?

You may generally use the data provided for any lawful purpose. For example, you may use it for repair, maintenance, energy optimisation or additional services.

However, the data may not be used to develop a connected product that competes with the product from which the data originates. It must also not be used to derive insights into STIEBEL ELTRON’s economic situation, assets or production methods. Deception, coercion or the exploitation of technical vulnerabilities to obtain access to the data is also prohibited.

Data protection and the rights of other persons

The EU Data Act complements existing data protection law and does not restrict it. If the requested data contains personal data, the requirements of the General Data Protection Regulation also apply. If personal data relates not only to you but also to other persons, STIEBEL ELTRON may provide it only where there is a valid legal basis under data protection law. Where necessary, data may be anonymised, restricted or excluded from disclosure. The EU Data Act does not create an additional legal basis for processing another person’s personal data. Trade secrets and security

Some data may contain trade secrets. In such cases, STIEBEL ELTRON may agree appropriate technical and organisational safeguards with you, such as confidentiality arrangements, secure access procedures or restrictions on use. Data may be restricted or withheld only in specific circumstances permitted by law. This may apply in particular where agreed safeguards are not observed, where disclosure of a trade secret is highly likely to cause serious economic damage, or where disclosure would undermine the product’s legal security requirements and thereby create a risk to human health or safety.

What happens after your request?

After receiving your request, we will assess whether the relevant product or related service is covered by the EU Data Act, what data is available and whether you are entitled to receive it. If we need further information, we will contact you. If the data cannot be provided in whole or in part, we will inform you of the reasons. Your statutory rights to contact the competent authority, refer the matter to a dispute settlement body or seek judicial redress remain unaffected.
